Simmons & Simmons launches service to help with marketing of funds

Simmons & Simmons has launched a new service to help its clients manage their way through the disparate and complicated rules relating to the marketing of open-ended funds, such as hedge funds.


The service was developed by Simmons & Simmons' financial services team and is named "Simmons & Simmons navigator: funds". It provides an easy to use and consistent source of information concerning the rules and requirements relating to fund marketing in approximately 60 countries, which differ greatly as a result of a lack of harmonisation.
The lack of consistency in the fund marketing rules creates significant challenges and complexity for financial institutions, especially those which wish to design uniform, but flexible processes and campaigns for investors in more than one country. This complexity also results in additional costs.


This new service covers licensing, product and marketing restrictions relevant to the distribution of open-ended funds (including funds which have been locally registered for distribution). It also outlines the local registration process for these funds in each country.
"The lack of harmonisation of the rules and requirements relating to fund marketing presents a regulatory nightmare for international businesses marketing funds.


The launch of 'Simmons & Simmons navigator: funds' brings much needed clarity to this area and will be a valuable tool for financial institutions wishing to market funds internationally,"
